Harvard Case - Beagle Channel Negotiations (A)
"Beagle Channel Negotiations (A)" Harvard business case study is written by Thomas Princen. It deals with the challenges in the field of Negotiation. The case study is 8 page(s) long and it was first published on : Jan 1, 1988
This case study analyzes the complex negotiations between Chile and Argentina over the Beagle Channel, highlighting the importance of international relations, negotiation strategies, and risk management in resolving territorial disputes. We recommend that Chile adopt a principled negotiation approach, focusing on win-win solutions while considering the power dynamics and cultural nuances involved. This strategy should prioritize long-term stability and regional cooperation over short-term gains, fostering a stronger relationship between the two nations.
2. Background
The Beagle Channel dispute centers around the sovereignty of three islands and several smaller islets located at the southern tip of South America. Both Chile and Argentina claim ownership of these territories, leading to a long-standing conflict that escalated in the 1970s. This case study focuses on the negotiations between the two countries in 1978, mediated by Pope John Paul II, aiming to reach a peaceful resolution.
The main protagonists are:
- Chile: Led by President Augusto Pinochet, the Chilean government is determined to secure its claim over the islands, emphasizing national pride and historical rights.
- Argentina: Under the leadership of President Jorge Rafael Videla, Argentina pursues a similar objective, viewing the islands as integral to its national identity and territorial integrity.
- Pope John Paul II: Acting as a mediator, the Pope seeks to facilitate a peaceful resolution, emphasizing the importance of dialogue and compromise.
3. Analysis of the Case Study
The Beagle Channel negotiations present a complex scenario involving:
- International Law and Territorial Disputes: The case highlights the challenges of resolving territorial disputes based on historical claims and international law, where interpretations often differ.
- Power Dynamics and Negotiation Strategies: Both countries employ different negotiation strategies, with Chile using a more assertive approach and Argentina adopting a more conciliatory stance.
- Risk Management and Conflict Resolution: The potential for military conflict looms large, emphasizing the need for effective risk management and conflict resolution strategies.
- Cultural Nuances and Cross-Cultural Negotiations: Understanding the cultural context and sensitivities of both countries is crucial for successful negotiations.
- Game Theory and Strategic Alliances: The negotiations can be analyzed using game theory, considering the potential payoffs and risks associated with different choices.
Framework: To analyze the case, we can utilize the Harvard Negotiation Project's framework, which emphasizes:
- Interests: Understanding the underlying interests of both parties beyond their stated positions.
- Options: Exploring a wide range of potential solutions that address the interests of both parties.
- Legitimacy: Ensuring that the final agreement is based on fair and objective criteria.
- Relationships: Building a strong and lasting relationship between the parties, even after the negotiations conclude.
4. Recommendations
Chile should adopt the following recommendations to achieve a favorable outcome in the Beagle Channel negotiations:
- Embrace Principled Negotiation: Focus on finding win-win solutions that address the interests of both countries, rather than pursuing a purely positional bargaining approach.
- Prioritize Long-Term Stability: Seek a resolution that promotes regional cooperation and long-term stability, minimizing the risk of future conflict.
- Acknowledge Cultural Nuances: Recognize the importance of national pride and historical claims for both countries, demonstrating sensitivity and respect for Argentina's perspective.
- Leverage the Pope's Mediation: Utilize the Pope's role as a neutral mediator to facilitate constructive dialogue and build trust between the parties.
- Consider Economic Cooperation: Explore opportunities for economic cooperation in the region, potentially linking the resolution of the territorial dispute to joint ventures and infrastructure development.
- Develop a Strong BATNA: Identify and strengthen Chile's Best Alternative to a Negotiated Agreement (BATNA), providing a credible fallback option in case negotiations fail.
5. Basis of Recommendations
These recommendations are based on the following considerations:
- Core Competencies and Consistency with Mission: Chile's commitment to peaceful resolution of disputes and its desire for regional stability align with the recommendations.
- External Customers and Internal Clients: The recommendations consider the interests of both Chilean and Argentinian citizens, aiming to foster a positive relationship between the two nations.
- Competitors: The recommendations acknowledge the potential for conflict with Argentina, but prioritize cooperation over confrontation.
- Attractiveness: The recommendations aim to achieve a long-term solution that minimizes the risk of future conflict and promotes economic development in the region.
- Assumptions: The recommendations assume that both countries are genuinely interested in finding a peaceful resolution and that the Pope's mediation will be effective.
6. Conclusion
By adopting a principled negotiation approach and prioritizing long-term stability, Chile can achieve a favorable outcome in the Beagle Channel negotiations. This strategy will foster a stronger relationship with Argentina, promoting regional cooperation and minimizing the risk of future conflict.
7. Discussion
Alternative approaches, such as pursuing a purely positional bargaining strategy or resorting to military action, carry significant risks. Positional bargaining could lead to a stalemate or a solution that fails to address the underlying interests of both parties. Military action would be highly destabilizing and could escalate the conflict, resulting in significant human and economic costs.
The recommendations are based on the assumption that both countries are genuinely interested in finding a peaceful resolution. However, if either country is unwilling to compromise, the negotiations may fail. Additionally, the Pope's mediation may not be successful in achieving a mutually acceptable agreement.
8. Next Steps
To implement these recommendations, Chile should:
- Establish a dedicated negotiation team: Composed of experts in international law, diplomacy, and conflict resolution.
- Develop a comprehensive negotiation strategy: Outlining the country's objectives, interests, and potential concessions.
- Engage in active dialogue with Argentina: Seeking to understand their perspectives and build trust.
- Utilize the Pope's mediation: Seeking his guidance and support in navigating the negotiations.
- Monitor the progress of the negotiations: Adapting the strategy as needed based on the evolving dynamics.
By taking these steps, Chile can increase its chances of achieving a successful and lasting resolution to the Beagle Channel dispute.

Case Description
On the border between Argentina and Chile, high in the Andes mountains, stands a tall, white statue of Christ, "El Cristo Redentor." It was erected by the Roman Catholic Church in 1904 as a symbol of peace and friendship between the two countries. In late 1978, some 500 youths from the two countries, along with priests and bishops, met at the foot of the statue to pray for peace. At the same time, troops were converging from both sides of the 3000 mile long border. And at sea, the Argentine and Chilean navies were heading south to a small passageway between the Atlantic and the Pacific called the Beagle Channel. This case (Part A) is the first of three parts that describe the Beagle Channel Dispute and the negotiations that took place between Argentina and Chile. Should be paired with HKS822 and HKS823. HKS Case Number 796.0.
